Trash Bin Troopers Terms of Service

The following are the terms of service (“TOS”) that govern the provision of services by Creative Forces, LLC (“Trash Bin Troopers”, “we”, “us”, “or our”) to you, and which govern the rights and responsibilities between Trash Bin Troopers and the purchaser or user of those services (“Customer”, “you” or “your”). These TOS, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Trash Bin Troopers on its website (collectively, the Agreement) constitute the entire agreement between Trash Bin Troopers and you regarding the Services (as defined in this Agreement). By using the Services, you agree to be bound by these TOS.

Residental Bin Cleaning

1. Service Description

Trash Bin Troopers, operated by Creative Forces, LLC, provides residential trash and recycling bin cleaning services using high-pressure water, biodegradable cleaning agents, and an environmentally responsible wastewater recovery system. All cleaning is performed on-site using a recovery pump system that captures wastewater to prevent runoff into storm drains and ensures proper disposal via the sanitary sewer system.
Our process eliminates bacteria, odors, and grime buildup while protecting your family, pets, and the environment. Services are available on a recurring or one-time basis. Customers enrolled in eligible subscription tiers receive complimentary bin-to-curb service before and after pickup during cleaning weeks.
Photo Documentation: Photos may be taken before and/or after cleaning to verify bin condition and service completion. Images are securely stored and used only for documentation and dispute resolution.

2. Customer Responsibilities

Bin Access: Bins must be accessible on the scheduled day. If bin-to-curb service is not included, customers must place bins curbside the evening before pickup.
Ownership: Customers confirm the bins belong to their household. Swapping bins with others is prohibited and will result in immediate cancellation without refund.
Eligibility: Only standard residential trash, recycling, or green waste bins emptied by the municipal collector will be serviced. Hazardous or full bins may be skipped.
Safety: Customers must ensure a safe environment free of hazards or aggressive animals.
Skips: One skip is allowed per contract with 48-hour notice. Additional skips may be rescheduled based on availability but are not guaranteed during busy seasons.
Photo Consent: Customers agree to photo documentation as outlined above.

3. Billing and Payment

Recurring Plans: Billed automatically per plan cycle. Contract terms:
- Monthly: 3-month minimum (3 cleanings)
- Bi-Monthly: 6-month minimum (3 cleanings)
- Quarterly: 12-month minimum (4 cleanings)

One-Time Service: Paid at booking. No contract.
Add-Ons: Additional cleanings at 25% discount. Additional bins: $10 per bin per cleaning.
Refund Policy: No refunds for completed services. Cancelled services may be credited at company discretion.
Payment Methods: Card and digital only. No cash unless pre-approved.
Failed Payments: Service paused until payment is resolved. Late fees may apply.
Auto-Renewal: Plans renew based on service frequency selected unless canceled with 14 days notice before next billing. Customers are notified before renewal.

4. Cancellations, Skips, and Termination

Customer Cancellation: Must notify at least 14 days before the next billing cycle.
Early Termination: $50 fee if canceled before contract term ends (waived for verified relocation).
- Specific to Long-Term Contracts with a minimum 1 year commitment

Auto-Renewed Plans: Cancel anytime with 14 days notice. No penalty.
Company Skips: May occur due to weather, holidays, equipment, or safety issues.
Misuse: Service may be canceled for bin swapping, repeated accessibility issues, or misconduct.

5. Liability Disclaimer

Pre-existing Conditions: Trash Bin Troopers is not responsible for pre-existing wear or damage.
Waiver of Liability: Customer waives all claims except in cases of gross negligence or willful misconduct.
Photo Documentation: Bins may be photographed before and after service.
Safe Practices: Services use eco-conscious cleaners, correct pressure, and proper disposal methods.
Pets: Customers must secure pets during service windows.
Property Access: Customers grant permission to access exterior premises for scheduled service.
Waiver Agreement: Customers must agree to the separate Bin Cleaning Liability Waiver before service begins.

6. Cleaning Frequency and Plan Terms

Recurring Plans:

Monthly: Every 4 weeks, 2 cleanings minimum
Bi-Monthly: Every 8 weeks, 2 cleanings minimum
Quarterly: Every 12 weeks, 3 cleanings minimum
Additional cleanings: 25% off contract rate
Additional bins: $10/bin

One-Time Cleanings: Flat rate per bin. No extras included.
Bin-to-Curb Add-Ons:

Standard: +$5/week (recurring plan customers)
- Includes same bins being cleaned
- Regular service with no contract
Premium: +$4/week (Contract customers)
- Includes same bins being cleaned
- Regular service with contract
A La Carte: $10/week (2 bins), $5.00/additional

Early Adopter Program: Includes bin-to-curb while cleaning equipment is being finalized. Locked pricing and at least 3 cleanings guaranteed during contract.

  - Designed to bring awareness of new business to neighborhoods while equipment is being manufactured
  - Available as Monthly recurring service (minimum 2 service dates, maximum 6 service dates): Every 4 weeks $45/month; 2 bins; Additional bins $5/bin
  - Available as Bi-Monthly recurring service (minimum 2 service dates, maximum 6 service dates): Every 8 weeks $65/service; 2 bins; Additional bins $5/bin
  - Early Adopter program includes:
    - 3rd can free,
      or
    - weekly bin-to-curb service
  - Additional bins $5/bin (regular $10)

Surface Cleaning Service

7. Service Description

In addition to residential trash bin cleaning, Trash Bin Troopers offers professional surface cleaning services for a variety of exterior areas, including but not limited to:

Driveways, sidewalks, and walkways
Patios, porches, and entryways
Pool decks and garage floors
Exterior siding, walls, and fencing
Stone, brick, and paver surfaces

8. Pricing

Surface cleaning services are billed separately from trash bin cleaning.
Rates begin at $0.40 per square foot, with a maximum of $0.50 per square foot.
The higher rate applies only to heavily stained surfaces requiring additional treatments or extended cleaning time.
Customers will receive a quote prior to service, and approval is required before work begins.
Additional charges may apply for targeted stain removal (e.g., oil, rust, or paint).

9. Service Requirements

Customers must provide access to a working outdoor water spigot for all surface cleaning services.
Customers are responsible for clearing vehicles, furniture, and other obstructions from service areas prior to cleaning.

10. Service Limitations

All services comply with local, state, and county water runoff and storm drain regulations.
While our equipment and solutions are designed to clean effectively and safely, some stains may not be fully removable. Results may vary.
Trash Bin Troopers is not liable for damage to pre-existing cracks, loose surfaces, deteriorated materials, or improperly installed surfaces.

11. Liability & Safety

Customers must notify us of fragile or sensitive areas that require special care.
Cleaning may be rescheduled in the event of unsafe weather conditions (heavy rain, lightning, or excessive wind).
By scheduling a surface cleaning service, the customer acknowledges and accepts these terms.

12. Communication & Privacy

Consent to Communicate: Customers agree to receive text, email, and phone communications regarding service.
Text Consent: Includes reminders, billing notices, service alerts, and limited promotions. STOP to opt out.
Privacy: No personal info is sold or shared. Used only for operational purposes.
Review Requests: Customers may receive follow-up invitations to review service (e.g., Google or Yelp).
Photo Use: Images are only used for service verification or internal documentation.

13. Legal Jurisdiction & Agreement Acknowledgment

Jurisdiction: Governed by the laws of California. Disputes handled in San Diego County courts.
Enforceability: If any clause is invalid, remaining provisions remain enforceable.
Entire Agreement: These Terms plus any signed waivers constitute the full agreement.
Acknowledgment: By receiving service or submitting payment, the customer agrees to these terms in full.

Trash Bin Troopers – Liability Waiver & Damage Disclaimer

I, the customer, acknowledge that I have voluntarily requested bin cleaning services from Trash Bin Troopers. I understand and agree to the following:

1. Pre-Service Inspection & Photo Verification:

Photos may be taken of my bins prior to cleaning to document their condition. These images will be stored securely by Trash Bin Troopers for reference if any damage claims arise. Photo documentation establishes baseline condition.

2. Assumption of Risk & Bin Damage Disclaimer:

I understand that trash and recycling bins are exposed to wear and tear from repeated use, environmental factors, and the mechanical collection processes of local sanitation departments. Trash Bin Troopers is not responsible for any existing cracks, warping, wheel failures, or damage caused by regular waste pickup or environmental exposure.

3. Safe Cleaning Practices:

Trash Bin Troopers performs all services using eco-conscious cleaners, appropriate pressure settings, and wastewater recovery systems in accordance with local regulations. However, cleaning may expose or exacerbate pre-existing damage or weaknesses in bins, such as cracks, broken wheels, or loose lids.

4. Waiver of Claims:

I release and hold harmless Trash Bin Troopers, Creative Forces LLC, and all employees, subcontractors, or agents from any and all liability related to damage to trash bins, personal property, or injury, except where caused by gross negligence or willful misconduct.

5. Agreement to terms:

By signing up for service, making a payment, or continuing to receive services from Trash Bin Troopers, the customer acknowledges that they have read, understood, and agreed to be bound by this Liability Release & Damage Disclaimer as well as the Terms of Service.
